That's not Cap. It's Norman Osborn (You know, ol' Green Goblin), who has overtaken Tony Starks position and got one of his old Armors. So, now he's calling himself the "Iron Patriot" and Leader of the Dark Avengers.

I got the Miku FLELE some time ago from an youtube video description. Just type in "Miku FLELE" and you'll find it.
