To be fair they really shouldn't have made it 1:1 to the original Zelda, or at least the first part since it wasn't finish, 3D or otherwise.  Free or no it still very much infringes on copy rights in this case since it is 1:1 the Original Zelda in various ways.  I can understand why they put up a cease and desist and the creators pretty much expected that it would happen sooner or later so they didn't take it so hard.

I mean yeah cease and desists aren't fun. However if they let something like this slide, even if it was free, it makes it harder to make a cease and desist when it really counts later down the road, and Nintendo or any company has a right to protect their IPs like this.  It's harsh, but it's understandable why they did what they did, that's just the reality of the law.

I remember the SOR Remake Project got shut down after SEGA contacted the team responsible and politely asked them to stop, as SEGA were planning to put out the SOR rereleases for XBLA and PSN.

It was pretty much just "Guys, you're making us look bad. Stop."

I mean yeah I never have hope for these so called 'fan remakes' because in the end it most likely won't see the light of day for various reasons.  Fan Games usually do better but even that has it's limits like what happened to those 2 Chrono Trigger fan games or that one Star Fox games. 

One example of an exception is Shigesato Itoi and the Mother games, people can do whatever the [tornado fang] they want since Itoi gave them the go ahead to do so, so now one of the most anticipated fan games is a fan made Mother 4.  There's a lot of interesting Mother fan games you can play thanks to Itoi being so lax about it since he's not going to be continuing the Mother series after all.

At least with Street of Rage Remake it is still circulating but it's not like it'll get any updates from the devs ever again. Also did PSN version got the re-release by M2? Their compilation is very good on XBLA since you get all three games plus their different regional versions (BK III wasn't translated sadly unlike Monster World IV), plus you can remap the controls, listen to the games' soundtracks, save and share replays, and it looks better than the one by Digital Eclipse.
