Capcom pursuing
legal action against Mighty No. 9 is most likely not going to happen, as some people fear. Why? Because it's a total lose-lose situation for Capcom, on many levels.
If they were to lose the case, Capcom would become an utter joke in the industry. Their already bad reputation becomes a lot worse, especially given the fact that they had the <i>intent</i> to shut down Mighty No. 9.
If they win, people are going to hate (and I mean, reeeeally hate) Capcom for shutting down the project. Meaning: actual boycotts, extremely negative press, severe strain on having to maintain PR (forums, interviews, etc.), etc.
It's in Capcom's best interest to stay quiet, or reveal a legitimate attempt at bringing back Mega Man. Mighty No. 9 is generating [a lot of] interest for Mega Man, which either means said project is no longer as risky (they have the KS to look at numbers), or their merchandising goes up anyways. Besides, Inafune/the team has been clear that this isn't a vendetta against Capcom, simply to prove them wrong (them being the "top men").
