Christopher Handley, a man from Iowa, was arrested for importing a manga from Japan. The reasons, the authorities claimed, is because the manga contained "a few obscene images." It remains undisclosed what kind of images these were. Regardless, if Mr. Handley is convicted, it will have a ripple effect on the entire manga and anime industry in the US. You will no longer be able to buy uncut and uncensored versions of your favorite anime. Your manga will be badly edited to cover up nudity and any swearing will be removed, so everything you read sounds and looks like it was made for seven-year-olds.
Also, he would be sentenced to at least 20 years in prison. For importing manga.

I was originally inclined to think that this was a case where some guy ordered a loli hentai doujinshi or something like that; however, after thinking about it, I realized this can't be the case. Simply because there's never just a "few obscene images" in a hentai doujinshi. Given this, I think that this was an ordinary manga that you could probably find in a book store.

Back on subject...How the hell did they know that this guy was importing manga? What right did they have to arrest him for 20 GODSDAMNED YEARS for importing manga? Was the "obscenity" objective? Were the police conservatives?

I know huh I mean I live in the US too and with this happening some of my favorite mangas may be banned because of showing boobs or some stuff like that like Gimmick, PHD (though I can't find any more anyway) etc. ;O;

For some reason? It's called censorship. It's this whole "Holier than thou" attitude of trying to make children into little obedient drones with little to no imagination anymore. It's been going on for a long time now. I like to call it the Dumbing Down of America. Cartoons, nowadays, are god awful. They pretty much have no story, no animation quality to them, and are seen, by this censorship [Top Spin]s, as mindless entertainment for kids.
These are the people who declare that Batman Beyond is too violent for kids, and thus cancel it. These are the people who censor Heero Yuy saying, "I Don't Believe In God" from the cut, non-Midnight Run version of Gundam Wing. I'll NEVER forget when I saw that. There is NOTHING vulgar about him saying that, but it was censored. So, not to point fingers here, but just remember that line and that should tell you who's really responsible for it.
That's actually why I want to give money to support this guy, because as the article says, it won't end. They won't just stop at Manga or Cartoons. Who knows how far they'll truly go.

The part that's bothering me slightly about all of this though is the fact that there are gonna be a lot of ignorants who are going to jump to attack Japanese animation (manga & anime) because it contains these themes yet they aren't going to realize that as a medium, all animation like everything else under the guise of art will ALWAYS contain these themes.

When you make someone directed toward an adult audience, there's going to be some crude humor, violence, sex, issues on sexuality, gender, race, and society. Why? Because adults require more stimulus than kids. Regardless of what people say, adults like to think about what they're watching. Kids don't.

It's like my mom says "Unfortunally 50% of the world is full of idiots." Plus it's like that stupid cause and effect kind of thing that doesn't make sense anymore "Oh no if manga is full of this we have to ban it to protect the children."
And like that other thread a week or 2 ago about GTA causing kids to stranggle a kitten thus using GTA as a scapegoat to avoid putting blaim on the parents for buying they game for 6 and 7 year olds in the first place. Seriously people are really going to cause something similar to Fahrenheit 451 if this keeps up.
Plus some of the so call cause and effect clause doesn't even apply anymore anyway with this real life example. My dad is mostly racist and married my Cuban mom and had me and my brother even though he is racist my brother and I are not. I have the common sense to know what's right and what's wrong and to judge people of not race or skin color but on how they act, and how they treat me and other people.
BTW this is 100% but my dad does have common sense in other cases but I won't go into it due to it being political.

In all honesty, I believe you are looking at the solution right now, that being the internet.
As I wrote in my Sociology Paper, what makes the internet so great, among many things, is the fact that they are no borders, no boundaries. The more the internet grows, I believe the older generation's bigotry and bias towards other races & religions will eventually fade away. Look at RPM. People from all over the world post on this site alone.
I believe it also to be the cure for this censorship bullshit too. The internet offers instant information. For every censored Manga, there is somewhere an uncensored version waiting to take it's place. And the thing is, it can't be stopped. Take Napster, for example. As soon as it was shut down, there were 5 versions it waiting to take it's place.
More and more, as humanity and technology advances, religion and bigotry dies a little. The younger generation slowly stop caring about such things, as there are websites to check, posts to make, tits to draw and see, games to play, music to listen to, and constant & instant information and communication waiting for them.

Well, obviously, this is a complete load of crap. Nobody has the right to tell you what manga you are and aren't allowed to read. Is he projecting these images on a screen for the town to see? No? Then what business did the authorities have at all here?
FYI: Yes, this is a Loli case (http://splashpage.mtv.com/2008/11/24/neil-gaiman-on-the-obscenity-of-manga-collector-christopher-handleys-trial/). Any other form of obscenity is protected for private possession (but not distribution or acquisition, so in theory, customs could still deny it but they couldn't make an arrest) under Stanley v. Miller, child pornography is the only exception as it is its own category.
Even so this case is STILL a load of crock. Not that I approve of loli, but a fictional character has no date of birth and therefore they cannot be regulated. Because any character may be depicted at any age, often unstated, the only way to even attempt to do so is visually. And this is frequently unclear, especially to those unfamiliar with the medium. How do you tell the difference in manga between a well-developed adolescent and a flat-chested adult? How do you tell an actual youngster from a wide-eyed art style that makes them appear young? How do you tell a prepubescent from someone who shaves? Not to mention the obvious factor of the amount of detail afforded by the artist and style used. It is entirely too ambiguous for any degree of precision to be applied in what is and isn't allowed. Furthermore, even if you got around all of that (say a particularly obvious image), child pornography laws exist to protect children, and you cannot protect what doesn't exist. The subject matter isn't a person, it's intellectual property.
Oh, and contrary to popular belief, the "PROTECT Act" of 2003 which Handley was charged under does not make any statement regarding fictional characters; it was written to address the presentation of a real-life of-age person as if they are not of-age. EDITS: Well, ALLEGEDLY, this was true, but upon examining the actual text it does state that it is not required that the depicted minor actually exist, so someone pulled a lot of PR bullshit there. This case is based around vague wording, and past amendments to child pornography laws have already been ruled unconstitutional for that very reason, so hopefully the same will happen here. The mention of obscenity in the law is the only reason this case didn't get thrown out earlier. In other words, at current, "obscene" lolicon is illegal while lolicon of "artistic value" isn't. Go figure.
The entire point of that section was supposed to be to allow prosecution of simulated child pornography that is indistinguishable from actual child pornography (CG fakes), to ease the burden in such cases where an offender claims that the government can't prove whether or not it was real (and let's be honest, if you can't tell whether or not the image is real, you shouldn't be looking at it in the first place). Nobody in their right mind would claim that a manga image is indistinguishable from an actual person. Hopefully a judge with any sense will realize that a fictional scenario of any sort falls under protected speech, and that even if obscene it's still protected for private possession as stated above.
Whatever may be the justifications for other statutes regulating obscenity, we do not think they reach into the privacy of one’s own home. If the First Amendment means anything, it means that a State has no business telling a man, sitting alone in his house, what books he may read or what films he may watch.

1.I feel it necessary to point out that anybody can say that anything is within/against their religion, regardless of whether or not a single other person on the planet agrees with them. The rants of an idiot(s) who does not recognize free will (nor, in the case of Christianity, the Parable of the Tares (http://en.wikipedia.org/wiki/The_Tares)) should never be taken as indicative of the body in its entirety. Such issues are up to individual interpretation.

The only thing I understand about censoring anime is the some harsh bad words and stuff but you shouldn't alter lines for religous reasons, seriously. Also don't alter the characters personality like they did with Kaiba and a few others I'm sure, as well as don't take out fight scences like they did in that one YuGiOh episode when Tristan somehow magically found Joey.
One more thing wouldn't it be cheaper to keep the Japanese songs instead of making new crappy american openings that make you want to puke, unless they did something similar to YuYu Hakusho openings. I have to admit I like some of the americanized songs better than the original Japanese ones plus the voice actting was pretty decent compared to what kind of characters they were. One more thing wouldn't it be cheaper to keep the Japanese songs instead of making new crappy american openings that make you want to puke, unless they did something similar to YuYu Hakusho openings. I have to admit I like some of the americanized songs better than the original Japanese ones plus the voice actting was pretty decent compared to what kind of characters they were. Personally I like most of the americanized Pokemon Openings up until Battle Frontier and at least they remixed the first Pokemon Opening at the same place they remixed the first Japan Openig at the same place I think. But any way the anime and game should of been more based of the true Pokemon manga anyway, but since it was made for kids pokemon has no real plot and reapetes the same message over and over again with Legendary Pokemon should coexsist with nature, growing up and blah blah blah. Seriously I want my evil elite 4 and screct Gym leader organization!

Yes, it was about mingling with the plot until it got mixed up right after "Pokemon" was mentioned. but seriously, Bakugan is currently being aired in the US CN, however, I was not able to watch the dubs to see if they screwed with the plot because it was so early when it aired. However, during the ad, the main character mentions "Gone like dinner!", I bet this is the typical steriotype of a protagonist who always thought of food and fighting. however, I think the plot meant much more than that.
Messing with the plot is true copyright infrigiment. In Japan, it was okay to use a character as long as they can keep the plot/try to merge the plot with thier's. (See: Mugen no Frontier, other crossover games) Now, it's all "Hey, a character that looks dangerously close to the origional character! Sue him!". Which explains why the characters in so many shows that have them appear (Such as Ken the Eagle in certain US cartoons) be edited.

I read through the entire topic, and I read the articles, and I only have one thing to say.
What the [tornado fang]?
Obscenity is a difficult subject because it's so hard to pinpoint. What may be considered obscene to one person maybe alright to another person. A judge, nor any single person, can't actually decide what is considered "obscene." To actually decide what is considered obscene the entire community has to decide upon that, not just one single person.
Now call me crazy, but even if the manga had "obscene" images in it, being sent to jail for 20 years over a [tornado fang]ing comic book is bullshit. Hell, being sent to jail at all is bullshit. It's a bunch of cartoons drawn on paper with ink, copied and then mass produced for sale.
There's something else too. Every manga, and I mean every manga, that I've bought over here in the states has had some rating on the back of the book indicating what age group would be most appropriate to reading said manga. It's kind of like the ratings on the back of movie boxes, except the ratings for manga is bigger and you can actually see it without having to look through the whole summary of the contents just to see a tiny line of text. If the defense was smart, then they'd bring up this rating system in court.
If you look at the ratings from each publisher they look different from each other, which means not only is there no regulated group in charge of the rating system for manga but the publishers are putting a rating on the back of the manga themselves. And for the most part these ratings have been pretty damn accurate.
This just reeks of people being too lazy to do any worthwhile research without yelling "Witch!"
Except in this case replace "Witch!" with "Pedo!"
